General Terms of Use (Customers)

1. Purpose and role of allogato
The present terms govern the use of the allogato marketplace by customers. allogato is a technical intermediary that connects customers with independent professional pastry chefs and cake designers (hereinafter referred to as "professionals"). The sales contract is concluded directly between the customer and the professional. allogato is neither a manufacturer, nor a seller, nor a distributor of the products; it provides a service for connection, secure payment processing, and mediation.
2. Customer account
Access to orders requires the creation of an account with accurate and up-to-date information. The customer may register as an individual or on behalf of a business. They are responsible for maintaining the confidentiality of their credentials and for any activity conducted from their account. The account is strictly personal.
3. Order placement
The customer selects a creation, exchanges information with the professional via the integrated messaging system as needed to specify their request (flavors, inscriptions, allergens, date and place of pickup or delivery), and then confirms their order. The order only becomes final after confirmation and payment. The professional may accept or refuse an order within the specified time; in case of refusal or lack of response, the customer is fully refunded.
4. Price and secure escrow payment
Prices are set and displayed by the professional, in euros, all taxes included. Payment is made entirely online, directly on allogato, through our approved payment service provider. allogato never retains your bank details.
Funds are held in escrow by the payment service provider and are only released to the professional after the proper receipt of the order. This mechanism protects the customer: as long as the order has not been delivered as agreed, money is not released to the professional.
5. Service fees and options
The displayed price may include clearly indicated service fees prior to payment (specifically for "Buyer Protection" when applicable). The detailed total amount, including fees, is systematically presented to the customer before confirmation and confirmed by email. No hidden fees are applied.
6. Absence of right of withdrawal
In accordance with Article L.221-28 of the Consumer Code, the right of withdrawal does not apply to the supply of goods "made to the specifications of the consumer or clearly personalized," nor to the supply of goods "liable to deteriorate or expire rapidly." The pastries offered on allogato being personalized and perishable, they fall under these two exceptions: no withdrawal is possible after order confirmation. The customer expressly acknowledges this by confirming their payment. This does not deprive the customer of any rights in case of a non-compliant or defective product (see Article 8).
7. Pickup, delivery, and allergens
The terms of delivery (pickup or delivery, date, time slot, location) are agreed upon with the professional at the time of the order. The customer ensures availability during the agreed slot and keeps the product under proper conditions (cold chain). The customer must inform the professional of any allergies or intolerances via messaging before placing an order. The professional is solely responsible for the composition, manufacturing, labeling of allergens, and food safety of the products.
8. Receipt, complaint, and dispute
Upon receipt, the customer verifies the compliance of their order. In case of a problem (non-compliant, missing, or damaged product), the customer can open a dispute from their order as soon as possible. The mediation team of allogato examines the situation impartially; the payment remains in escrow until resolved. Depending on the outcome, a full or partial refund may be decided. The customer also retains their legal rights against the professional (compliance guarantee, warranty against hidden defects) and the option to refer to a consumer mediator (see legal notices).
9. Reviews
Only a customer whose order has actually been fulfilled can submit a review. Reviews engage their author; they must be fair, sincere, and free from illegal content. allogato may moderate or remove a manifestly abusive review, off-topic, or contrary to the law.
10. Transactions and exchanges outside the platform
Any order, payment, or exchange made outside of allogato results in the loss of all protections associated with the service (escrow, Buyer Protection, mediation, traceability). allogato strongly disapproves of such practices and disclaims any responsibility in this regard.
11. Liability
In its capacity as an intermediary, allogato's liability is limited to the proper provision of the connection service, secure payment processing, and mediation. allogato is not responsible for the manufacturing, quality, compliance, taste, or sanitary safety of the products, which are the sole responsibility of the professional. allogato cannot be held liable for indirect damages.
12. Intellectual Property and Messaging
The client is prohibited from any abusive use of the site, any data extraction, and any illegal content in the messaging. Exchanges may be subject to automated and human moderation to prevent fraud and disintermediation, under the conditions described in the privacy policy.
13. Personal Data, Amendments, and Applicable Law
The processing of data is described in the privacy policy. allogato may amend these terms; the applicable version is that in force on the date of the order. These terms are governed by French law. Any dispute falls, failing amicable resolution, under the competent courts.
